#20-065 On May 29, 2020, the Stewards received notice from Truesdail Laboratories, Inc. that blood sample #36878, dated February 23, 2020, contained the drug phenylbutazone
at 6.7 +- .56mg/ml which is in excess of the accepted threshold level of 0.3mg phenylbutazone established by the MRC. See COMAR 09.10.03.01. The Stewards, having established that blood sample #36878 was taken from the horse “Fairy Wish”, owned by Mrs. Janon Fisher, III and trained by Janon Fisher, III, following the running of the second race at Laurel Park on February 23, 2020. The Stewards notified Mr. Fisher that: (1) the presence of phenylbutazone, at this level, in the system of “Fairy Wish” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) he had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) he had the right to be represented by counsel at the hearing.

The Stewards held a hearing on May 31, 2020 wherein Mr. Fisher waived his right to legal counsel and a split sample.

Based upon the evidence before them, the Stewards find the following:

(1) “Fairy Wish” did carry phenylbutazone, in its system when it finished second in the second race at Laurel Park on February 23, 2020, a violation under COMAR 09.10.03.04,C;
(2) Janon Fisher, III, as trainer, was the absolute insurer of, and responsible for, the condition of “Fairy Wish” at the time the horse ran (Sections D & F);
(3) A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
Based upon the foregoing and taking into account mitigating circumstances, the Stewards hereby order that:

The horse, “Fairy Wish” be disqualified from the second race from February 23, 2020.

#20-066 In the eighth race, at Laurel Park on June 5, 2020, horse #12 “Swirlie Shirlie”, ridden by Jockey Katie Davis was disqualified
from second position and placed fifth. Outside the 1/8th pole, #12 “Swirlie Shirlie”, drifted in and came over into the path of #5 “Flirtation Walk” ridden by Jorge Ruiz, forcing that horse in a few of paths.
[Violation under COMAR 09.10.01.50, A (1) b & d, which states in pertinent parts: “A horse may not: (a) Carry another horse in or out: (d) Intimidate another horse.]

#20-067 In the matter of Apprentice jockey Antonio Quiles
, having provided all documentation pertinent to his injury of October 5, 2019, Apprentice jockey Quiles is hereby granted fifty (50) days of extension to his apprentice certificate, which would have expired on November 29, 2019. This extension will now continue his apprentice allowances starting June 5, 2020 thru August 1, 2020.

June 6, 2020 - Laurel Park
#20-068 In the first race, at Laurel Park on June 5, 2020, horse #4 “Dorothyfromdublin”, ridden by Jockey Trevor McCarthy was engaged with the assistant starter as the field broke.
The horse was off a little late but the jockey put the horse into the race where she subsequently finished third. An Inquiry was posted after the race and it was determined by the Stewards that all wagering on #4 ”Dorothyfromdublin” be refunded. The Stewards also determined that having finished third in the race, “Dorothyfromdublin” be considered a starter for purse money.
